Lawyer Khaminsky explained the advisability of mitigating liability for tax evasion

Tax lawyer Alexander Khaminsky shared the details.;“We are in favor of the relaxation of criminal law for entrepreneurs, but not of permissiveness. The business community’s proposals to humanize criminal legislation for entrepreneurs coincided in spirit and letter with the initiatives announced by the President (Vladimir Putin) in his message to the Federal Assembly,” explained Alexander Khaminsky, Member of the General Council of Delovaya Rossia.<p>According to the lawyer, entrepreneurs today are one of the pillars on which Russian society is based. This is why the Head of State urged the authorities not to go too far in the implementation of control, surveillance and law enforcement activities. At the same time, Khaminsky continued, the humanization of legislation does not equal leniency for past sins and impunity.;“The Penal Code is not a dead dogma, its standards must meet the demand of the State and the expectations of citizens in the current conditions. The penalty, including the form, must correspond to the crime it entails. Of course, acts such as terrorism, high treason, murder, drug distribution and other serious and particularly serious crimes should be punished with imprisonment up to life. But crimes in the economic sphere are of a completely different nature, and therefore the doctrinal approach to punishment should also be different,” the tax lawyer believes.<p>Crimes committed as a result of the economic activity of citizens have already been distinguished in a separate category, regardless of the chapter of the code to which the relevant articles belong. They are listed in art. 108 of the Code of Criminal Procedure of the Russian Federation as not implying a coercive measure in the form of arrest, with some exceptions.

The Law on Mitigating Liability for Tax Fraud and Other Payments, passed earlier by the State Duma in its third reading, will give confidence to entrepreneurs operating at their own risk and protect the rights and interests of Russians who are become victims of fraud, Khaminsky is convinced.
