For the first time, an officer of the Armed Forces of the Russian Federation was accused of an unprevented attack by Ukraine on Russia

The Russian military investigation system registered the first case of charges under Article 340, Part 2 of the Criminal Code of the Russian Federation, which provides for a prison term of up to 10 years for violation rules of combat duty. The indicted officer failed to prevent the attack of the Ukrainian armed forces on the territory of the Russian Federation, which resulted in the death and injury of servicemen and damage to military equipment, writes Kommersant.
According to information received by journalists from sources close to the investigation, a criminal case was opened last spring in connection with the rocket attack on military installations in the Belgorod region of the Armed Forces of Ukraine. Initiating a case, the 1st Department of the Military Investigative Department of the Investigative Committee of Russia for the Western Military District claims that the incident was caused by insufficient air defense coverage in the border area by air defense systems .
Given the serious consequences of this incident – according to the court’s decision, 7 servicemen were killed as a result of the strike, 43 were injured and received shells, and 15 equipment was destroyed and 30 damaged for a total of 89 million rubles – military investigators decided to apply part 2 of this article of the Criminal Code of the Russian Federation, which is a rather unique case in judicial practice.

As part of the criminal case over the raid, the only defendant appeared – an officer who was on combat duty during the attack. The investigation claims that he failed to fulfill his obligations to prevent the attack of the Ukrainian Armed Forces, thereby causing serious damage to the country’s defense capability. In addition to article 340 of the Criminal Code of the Russian Federation, the charge also includes part 3 of article 286 of the Criminal Code of the Russian Federation for abuse of power, because the defendant committed serious errors of calculation in the organization of the combat service of his subordinate. unit.
According to Kommersant’s sources, the defendant does not admit his guilt and constantly appeals against the chosen restraint measure. He also contests the interim measures applied to him by the Kursk garrison court.
