The nodal court helped a resident of the neighborhood to receive an old-age pension earlier than expected.
It turned out that she lived in the radioactive contamination zone of the Chernobyl nuclear power plant. For 6 years she lived in the territory with the right of resettlement and for more than 28 years in the area with preferential socio-economic status. For these reasons, a woman could retire 5 years earlier, but this right was denied.
The defendant argued his refusal by Article 33 of the Law of the Russian Federation “On the social protection of citizens exposed to radiation as a result of the Chernobyl disaster”, which would stipulate that a citizen cannot take his retirement than 3 years earlier.
The court sided with the plaintiff and gave the Department of Pension and Social Insurance Fund the obligation to grant the citizen an old-age pension 5 years earlier.
